These Terms and Conditions set out the basis on which Tree Surgeons Anerley provides tree surgery and related arboricultural services to residential, commercial, and public-sector clients. Booking Process
All bookings begin with an initial enquiry and a description of the work required. In many cases, we may request photographs, access details, tree locations, or other information before confirming a quotation. A quotation may be based on the information available at the time, and if the actual site conditions differ materially once work begins, we reserve the right to revise the price or suspend the job until the change is agreed.
Bookings are only confirmed when we have issued confirmation by email, text, or other written means, and you have accepted the quotation or provided clear instruction to proceed. A booking date or time estimate is not a guarantee that work will start at that exact moment, particularly where access, weather, traffic, or earlier jobs affect scheduling. We will use reasonable efforts to attend as planned, but the tree surgery industry can be affected by factors outside our control. For that reason, we may need to reschedule appointments where safety, equipment availability, or operational requirements make attendance impractical.
You must ensure that the site is ready for the agreed service on the appointed day. This includes providing safe access, advising us of any hidden hazards, securing pets, moving vehicles where necessary, and informing us of any underground or overhead services that may affect the work. If consent is needed from a landlord, freeholder, neighbour, or local authority, it is your responsibility to obtain it before the work starts unless we have expressly agreed in writing to assist with the process. Where work is delayed because required consent has not been obtained, we may treat the booking as cancelled or postponed under our cancellation terms.
Payments and Charges
Our prices are usually quoted either as a fixed fee or as an estimated fee based on the information supplied. Unless stated otherwise, quotations are valid for a limited period and may be withdrawn or amended if the scope of work changes, disposal requirements increase, or site conditions are materially different from those described. Any price quoted is exclusive of additional work that is not part of the original specification. Payment terms will be confirmed at the time of booking or in the quotation. You may cancel or reschedule a booking by giving us reasonable notice. If you cancel after we have reserved time and resources for your job, we may charge a cancellation fee that reflects our reasonable costs and lost opportunity, especially where the booking involved a substantial allocation of labour or equipment. Any non-refundable deposit may be retained to the extent permitted by law and in line with the specific quotation.
If weather conditions, access restrictions, safety concerns, or other circumstances make it unsafe or impractical to begin or continue the work, we may postpone the booking without liability for any indirect losses. Severe wind, heavy rain, ice, lightning, or unstable ground can make tree surgery unsafe, and our decision on safety will be final on the day. If we have already attended site and are unable to proceed because the site is not prepared, access is blocked, or required permissions are missing, we may charge a call-out or waiting-time fee. We will act reasonably and only apply such fees where justified by the time and expense incurred.
If you request a date change after confirmation, we will try to accommodate it, but alternative dates depend on our schedule and the availability of the necessary team and equipment. Repeated changes may require a revised quotation. For urgent work, particularly where storm damage or dangerous trees are involved, we may prioritise safety-related call-outs over non-urgent bookings. In all cases, any refund, retention, or cancellation charge will be assessed fairly and in line with the Consumer Rights Act 2015 where that legislation applies.
Liability and Risk
We will perform our services with reasonable care and skill, using appropriately trained personnel and suitable equipment. However, tree surgery is an inherently hazardous activity, and some level of risk remains even when all reasonable precautions are taken. To the fullest extent permitted by law, we are not liable for loss or damage arising from pre-existing defects, hidden decay, unstable trees, underground services, defective structures, or inaccurate information supplied by the client. This includes situations where a tree appears healthy externally but contains internal weakness not visible without invasive inspection or specialist testing.
Our liability for direct loss or damage caused by our negligence is limited to the amount paid or payable for the specific service, except where the law says otherwise. Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot legally be excluded. We are not responsible for indirect or consequential loss, including loss of profit, loss of business, loss of opportunity, or inconvenience, unless such loss is expressly recoverable under statute. We recommend that clients hold appropriate insurance for their property and contents where relevant.
Where work is carried out near fences, sheds, paving, driveways, walls, greenhouses, cables, pipes, or neighbouring property, reasonable care will be taken to avoid damage. Nevertheless, some minor marking, vibration, or ground disturbance may be unavoidable in order to complete tree surgery safely. If you require special protective measures, you must notify us before the work begins. Any claim relating to damage must be reported as soon as reasonably possible and in any event within a reasonable time after discovery, together with evidence supporting the claim. We may inspect the site and preserve any relevant material before making a decision.
Waste, Woodchip, and Regulatory Compliance
All waste produced during the job, including branches, timber, foliage, stump grindings, and related arisings, will be handled in accordance with applicable UK waste legislation. Unless otherwise agreed, we will remove and lawfully dispose of waste arising from the works as part of the service or as separately priced in the quotation. Where material is left on site at your request, it becomes your responsibility from the point of handover, and you must ensure that it is stored and disposed of in a lawful manner. We may charge extra for additional waste, difficult access, or unusually heavy volumes of material.
We operate in line with the Environmental Protection Act 1990, the Waste (England and Wales) Regulations 2011, and any relevant duty-of-care obligations. Waste transfer may be documented where required, and we may use licensed waste carriers, recycling facilities, or authorised disposal sites. You must not request that we dispose of waste unlawfully, burn waste contrary to local rules, or leave material where it could create a nuisance or hazard. If you ask us to leave timber, logs, mulch, or chip on site for reuse, we will do so only if it is safe and agreed in advance.
We will also operate in accordance with applicable health and safety laws, including the Health and Safety at Work etc. Act 1974 and the Work at Height Regulations 2005 where relevant. While we take care to protect property and personnel, tree surgery may involve falling material, machinery noise, temporary obstruction, and limited access. You agree to keep children, pets, and unauthorised persons away from the work area during operations. If third parties ignore safety instructions or enter the work zone without permission, we may pause the service until the risk is removed.
Client Responsibilities and Service Conditions
The client is responsible for ensuring that the trees or related structures are lawfully available for work and that the information supplied to us is accurate and complete. If a tree is protected by a Tree Preservation Order, located in a conservation area, or otherwise subject to statutory restriction, you must tell us before the job is booked. We may ask for evidence of any permissions, and we reserve the right to refuse or pause work if the necessary approvals are absent. Any delays or losses caused by incorrect or incomplete information provided by the client remain the client’s responsibility.
You must also ensure that the working area is reasonably clear and that any fragile items, decorations, garden furniture, ornaments, or vehicles likely to be affected are removed or protected before we arrive, unless we have agreed to do this as part of the service. Where our team requires water, electricity, parking, or other site support, you should make reasonable provision if this has been agreed beforehand. We may refuse to start or continue work where conditions on site are unsafe, unlawful, or materially different from the description provided at booking.
Any amendment to the agreed scope must be recorded in writing where possible. Verbal requests made on the day may be accepted if they are safe and practical, but they will be chargeable in addition to the original quotation. If unforeseen issues are identified during the work, such as concealed structural decay, pest damage, or instability requiring additional safeguards, we may stop and notify you of the options. In those circumstances, continuation of the service will depend on your approval, the suitability of the revised approach, and any additional cost being agreed.
General Legal Terms
These terms are governed by the law of England and Wales. Any dispute or claim arising out of or in connection with the services, these terms, or any associated quotation will be subject to the exclusive jurisdiction of the courts of England and Wales, unless mandatory law provides otherwise. If any provision is held to be invalid or unenforceable, the remaining provisions will continue in full force. No failure or delay by us in enforcing any right or remedy will amount to a waiver of that right or remedy.
Nothing in these terms creates a partnership, joint venture, or employment relationship between us and the client. We may use subcontractors or associated professionals where appropriate, provided that this does not materially affect the quality of service. Any notices relating to the service may be given by email, text message, or other reasonable written method. If a court or regulator requires any part of these terms to be interpreted narrowly, the remaining parts will be construed to preserve, as far as possible, the original commercial intention.
